依勞動部上揭函文,相關法規及宣導事項摘述如下:
(一)禁止刊登大陸地區勞務廣告:
1、臺灣地區與大陸地區人民關係條例(下稱兩岸條例)第34條第1項規定:「依本條例許可之大陸地區物品、
勞務、服務或其他事項,得在臺灣地區從事廣告之播映、刊登或其他促銷推廣活動。」同條第4項規定:
「第1項廣告活動之管理,除依其他廣告相關法令規定辦理外,得由行政院大陸委員會會商有關機關擬訂管理辦法,報請行政院核定之。」第89條規定:「委託、受託或自行於臺灣地區從事第34條第1項以外大陸地區物品、勞務、服務或其他事項之廣告播映、刊登或其他促銷推廣活動者,或違反第34條第2項、或依第4項所定管理辦法之強制或禁止規定者,處新臺幣10萬元以上50萬元以下罰鍰。前項廣告,不問屬於何人所有或持有,得沒入之。」
2、大陸委員會依前開規定訂定之「大陸地區物品勞務服務在臺灣地區從事廣告活動管理辦法」第6條第5款規
定略以,未經許可之大陸地區勞務,不得在臺灣地區從事廣告活動或以置入性行銷方式為之。第12條第1項
第1款規定略以,委託、受託或自行於臺灣地區從事兩岸條例第34條第1項以外大陸地區物品、勞務、服務或
其他事項之廣告播映、刊登或其他促銷推廣活動,依兩岸條例第89條第1項規定,處新臺幣10萬元以上50萬
元以下罰鍰。
(二)禁止仲介國人赴陸就業:
1、兩岸條例第35條第2項規定:「臺灣地區人民、法人、團體或其他機構,得與大陸地區人民、法人、團體或
其他機構從事商業行為。但由經濟部會商有關機關公告應經許可或禁止之項目,應依規定辦理。」第86條
第4項規定:「違反第35條第2項但書規定從事商業行為者,處5萬元以上500萬元以下罰鍰,並得限期命其
停止或改正;屆期不停止或改正者,得連續處罰。」
2、經濟部依兩岸條例第35條第2項但書規定公告之「在大陸地區從事商業行為應經許可或禁止之事項公告項目
表」,將「從事臺灣地區人民赴大陸地區就業之人力仲介業務」列為禁止類。
3、就業服務法第34條第2項前段規定略以,未經許可,不得從事就業服務業務。第65條第1項規定略以,違反第
34條第2項規定者,可處新臺幣30萬元以上150萬元以下罰鍰。
三、據悉中國大陸迭有透過陸商、臺商、外商或非法仲介招攬臺灣人才赴陸就業,又其中不乏有向核心重點大學招攬高科技人才之情形,對於我國科技安全及產業發展已構成潛在風險。爰為強化學校及在校學生對相關法規之認知,及
避免民眾誤觸法規,勞動部業製作旨揭宣導資料,請貴校加強宣導並協助周(轉)知所屬教職員工生,俾提升法遵意識,共同維護我國關鍵人力及科技資安。另請貴校(並協助轉知轄管各級學校、附設醫院及農林場等)避免提供或出借校園教室、禮堂、操場等室內及戶外場地予各單位(包含私立就業服務機構),辦理相關活動(如:大陸就業市場說明會、招募國人赴陸就業、大陸臺商校友就業座談等),以免間接促成國內人才被不當挖角。
According to the aforementioned letter from the Ministry of Labor, relevant regulations and promotional matters are summarized as follows:
(1) Prohibition on the Publication of Mainland China Labor Service Advertisements:
1. Article 34, Paragraph 1 of the Act Governing Relations between the People of the Taiwan Area and the Mainland Area (hereinafter referred to as the Cross-Strait Regulations) provides: "Mainland China goods, labor, services, or other matters permitted under this Act may be advertised, published, or otherwise promoted in Taiwan." Paragraph 4 of the same article provides:
"In addition to being governed by other advertising-related laws and regulations, the management of advertising activities under Paragraph 1 may be formulated by the Mainland Affairs Council of the Executive Yuan in consultation with relevant agencies and submitted to the Executive Yuan for approval." Article 89 provides: "Entrusted, entrusted, or acting independently in Anyone in Taiwan who broadcasts, publishes, or engages in other promotional activities for mainland China goods, labor, services, or other matters other than those specified in Article 34, Paragraph 1, or violates the mandatory or prohibitory provisions of Article 34, Paragraph 2, or the regulations prescribed pursuant to Paragraph 4, shall be fined not less than NT$100,000 but not more than NT$500,000. Advertisements referred to in the preceding paragraph, regardless of ownership or possession, may be confiscated.
2. Article 6, Paragraph 5 of the "Regulations Governing Advertising Activities of Mainland China Goods, Labor, and Services in Taiwan," promulgated by the Mainland Affairs Council pursuant to the aforementioned regulations, provides that mainland China services may not engage in advertising activities or product placement in Taiwan without permission. Article 12, Paragraph 1
Subject to the provisions of Paragraph 1, any person who, on behalf of, or independently engages in advertising, publishing, or other promotional activities in Taiwan for mainland goods, labor, services, or other matters other than those specified in Article 34, Paragraph 1 of the Cross-Strait Regulations, shall be subject to a fine of not less than NT$100,000 and not more than NT$500,000 in accordance with Article 89, Paragraph 1 of the Cross-Strait Regulations. (2) Prohibition on brokering Taiwanese nationals for employment in the Mainland:
1. Article 35, Paragraph 2 of the Cross-Strait Agreement stipulates: "People, legal persons, organizations, or other institutions in the Taiwan area may engage in commercial activities with people, legal persons, organizations, or other institutions in the Mainland area. However, the Ministry of Economic Affairs, in consultation with relevant authorities, shall announce that any business activities that require approval or prohibition shall be handled in accordance with relevant regulations."
Article 86, Paragraph 4 stipulates: "Anyone who engages in commercial activities in violation of the proviso to Article 35, Paragraph 2 shall be fined not less than NT$50,000 but not more than NT$5,000,000 and may be ordered to cease or correct the violation within a specified period. Failure to cease or correct the violation within the specified period shall be subject to continuous penalties."
2. The Ministry of Economic Affairs, in accordance with the proviso to Article 35, Paragraph 2 of the Cross-Strait Agreement, has listed "engaging in human resources brokerage business for Taiwanese nationals to find employment in the Mainland area" as prohibited.
3. The first paragraph of Article 34, Paragraph 2 of the Employment Services Act omits the provisions that prohibit engaging in employment services without approval. Article 65, Paragraph 1, provides for the following: Violations of Article 34, Paragraph 2, may result in a fine of not less than NT$300,000 and not more than NT$1,500,000.
3. It has been reported that mainland China has repeatedly used mainland, Taiwanese, foreign, or illegal intermediaries to recruit Taiwanese talent for employment in mainland China. Some of these efforts have involved recruiting high-tech talent from key universities, posing a potential risk to Taiwan's technological security and industrial development. To enhance awareness of relevant regulations among schools and students and prevent the public from erroneously violating them, the Ministry of Labor has produced promotional materials. Your school is requested to strengthen these promotional materials and assist in disseminating them to faculty, staff, and students to enhance legal awareness and jointly safeguard the security of Taiwan's critical human resources and technological information. We also ask your school (and please inform all schools at all levels, affiliated hospitals, and agricultural and forestry farms under its jurisdiction) to avoid providing or lending campus classrooms, auditoriums, playgrounds, and other indoor and outdoor venues to various units (including private employment service agencies) for related activities (such as: mainland China job market briefings, recruitment of Taiwanese citizens for employment in mainland China, employment seminars for Taiwanese alumni in mainland China, etc.), so as to avoid indirectly facilitating the improper poaching of domestic talents.
